Terms and Conditions

By accepting our estimate to carry out works you are accepting the terms and conditions set out below:
  1. Acceptance: The acceptance of this estimate/quotation, or the placement of an order, includes the acceptance of these terms and conditions which shall apply between us, Aquatic Solutions UK (the ‘Company’) and the Customer who shall be the party accepting this estimate or placing an order with us.
  2. Contract: These terms and conditions shall apply as the binding and entire Contract between the Company and the Customer and are to be read in conjunction with the particulars of any estimation/quotation documentation.
  3. Estimate and Errors/Discrepancies: Our Estimate/quotation shall constitute our best estimate for the entire scope of works but shall be subject to amendment as required. Our Estimate/quotation is based on the information provided to the Company at the time of preparing such estimate/quotation or based on the site conditions existing at the time of the formation of the contract, remaining unchanged for the duration of the contract. Should errors or discrepancies become evident which affect our order value, the Company reserves the right to make any adjustments.
  4. Deposits: The Company reserve the right to request a deposit prior to commencement of works.
  5. Fees and Payment: The Company will issue an invoice on completion of works which is payable within 14 days of issue. The Company reserve the right to charge interest on all overdue accounts from the date the payment as due at a rate of 4% above the Bank of England base rate. On larger value projects interim payments may apply and be agreed prior to works commencing.
  6. Cancellations: Should the Customer cancel the contract The Company reserve the right to charge a cancellation fee up to 50% of the value of the contract if cancelled within 7 working days of the commencement of the contract.
  7. Services: The services shall be rendered in accordance with specification set out in the accepted estimate. The Company may provide sketches, impressions or plans in advance of the job and any such material is intended for illustrative purposes only, not intended to provide an exact specification nor to guarantee specific results. The Company shall ensure that all works are carried out with reasonable care and skill and that our best standards are applied that is commensurate with best trade practice. The Company may instruct the Customer to make reasonable steps to protect their property from damage and The Company shall not be liable for any damage that occurs due to the Customers failure to follow such instructions. The Customer shall ensure that the Company is made aware of any liners, pipework, cables or hazards within the watercourse/waterbody. The Company will ensure that extra care is taken to preserve these items but no liability shall be taken for any damage that may occur. The Company shall ensure that the Customers property is kept in clean and tidy order as much as practicable with the nature of the works.
  8. Variations: The Customer must advise The Company of any variations as soon as possible prior to the commencement of works. The Company will endeavour to accommodate variations if prior notice is given.
  9. Programme: all such times given are treated as estimates only and unless otherwise agreed in writing we shall have no obligation to complete works by a specified date.
  10. Insurances: The Company carries 10 million Public Liability, 5 million Employers Liability and 1 million Professional Indemnity. All Machines and equipment are fully insured.
  11. Data protection: The Company will not share the Customer personal details with any third party for any reasons without prior consent by the Customer.
  12. Products: All products, materials and plants are supplied in good condition at the time of planting, installation or application. Every care will be taken to plant, apply or install in the correct manner or as per manufacturers specifications, to ensure the best outcome. The Company is not responsible for failure due to weather conditions or environmental changes outside of their control.
  13. Post Works: Depending on the nature of the works regrowth of the vegetation may occur. The Company makes no guarantees that works carried out by them will eradicate all vegetation and the Customer will be advised of this at the point of Estimation of the works. By agreeing to these terms and conditions the customer accepts that regrowth may occur.
